3 May An agent was affiliated with my company. May 3, 2017 By Cindy Sellers Commission, Ethics 0 This is a topic that should be addressed in the independent contractor agreement between the broker and the agent. There is no law or regulation that explicitly obligates a broker to pay a full commission to an agent who leaves the firm before a transaction that the agent was working on closes. The agent or her attorney could always attempt to craft a legal argument premised on general contract principles that the agent is entitled to full compensation for the services that the agent performed. However, the lack of a law or regulation that the agent can claim the broker violated and the inability of the agent to point to a particular provision of a contract that the broker violated makes the agent’s argument more difficult to make.
